1. Definitions
- "Lead" means a consumer record we deliver to you, containing data such as name, phone number, email address, state, and credit qualification.
- "Lead data" means all information included in or derived from a Lead.
- "Credits" means prepaid lead units in your balance; each delivered Lead consumes one Credit unless credited back under the Return Policy.
- "Delivery" means making a Lead available to you by email, in your dashboard, or to your CRM webhook.
- "Appointment" means a call our appointment team schedules between a buyer and your closer on the calendar you provide.
- "Appointment credit" means one prepaid appointment unit; one credit is used when an appointment is booked on your calendar.
- "Return Policy" means our Return Policy, which is incorporated into this Agreement.
2. The leads
Each Lead is a consumer who opted in through our own funnels, just bought an online business/e-commerce program, and passed a soft credit check with a 670+ score. Leads are delivered in real time by email, in your dashboard, and optionally to your CRM webhook. We do not guarantee that a Lead will answer, be interested, qualify for your offer, or result in a sale. Our obligation is to deliver the Lead data described in this Agreement.
3. Exclusivity and license
Leads are exclusive: each Lead is sold to one buyer only. Subject to your compliance with this Agreement, we grant you a non-exclusive, non-transferable, revocable license to use Lead data solely for your own internal sales and service use. You may not resell, rent, share, publish, broker, or otherwise redistribute Lead data, in whole or in part, and you may not use Lead data to build or enrich any database, list, or product other than for your own internal sales use. You may permit your employees and contractors to access Lead data for that use, provided they are bound to confidentiality and use restrictions at least as protective as this Agreement, and you remain responsible for their acts and omissions. We do not transfer ownership of the data to you.
4. Compliance when contacting leads
You are solely responsible for complying with all laws that apply when you contact Leads. Without limiting that obligation, you agree that you will:
- comply with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), state mini-TCPA and telemarketing laws, and federal and state Do Not Call (DNC) requirements that apply to you;
- observe applicable calling quiet hours and any time-of-day and day-of-week restrictions in the Lead's state;
- scrub your calling lists against the National Do Not Call Registry and applicable state registries as required, maintain your own internal do-not-call list, and honor do-not-call and opt-out requests;
- identify yourself truthfully and the entity you represent at the beginning of each contact, as required by applicable law;
- comply with call recording consent and disclosure laws that apply in the relevant jurisdictions; and
- comply with all other applicable consumer-protection, privacy, and communications laws.
We make no representation or warranty that any contact you make with a Lead complies with applicable law.
5. No misrepresentation or guarantee claims
When contacting Leads or referring to this Service, you must not make false, misleading, or deceptive statements, including about the consumer's credit status, any affiliation with us or any government agency, or the terms of any offer you present. You must not represent to consumers that any outcome, approval, financing, or benefit is guaranteed.
6. Data security and breach notice
You must protect Lead data with reasonable administrative, technical, and physical safeguards, limit access to employees and contractors who need it for your permitted use, and not store Lead data on unsecured systems. You must notify us promptly, and in no event later than 48 hours after confirming, at ed@redeyeleads.com if you suspect unauthorized access to or disclosure of Lead data, and cooperate with us on investigation and any legally required consumer or regulator notifications.
7. Delivery settings and caps
You set your daily and weekly volume caps, delivery days, hours, and time zone. We may pause delivery to you for quality issues, suspected fraud or unlawful use, payment failure, or operational necessity, and will notify you when practical. If we pause delivery for our own operational reasons for an extended period, you may request a credit for the unused balance.
8. Credits and pricing
Leads are prepaid and purchased as packs of Credits. The current price is $200 per Lead; the minimum order is 25 leads. Purchases are non-refundable, except for credits issued under the Return Policy. If you enable auto top-up, you authorize us to charge your saved card through our payment processor for the pack size you selected when your balance falls below your threshold. You may disable auto top-up at any time.
9. Returns
Returns are governed by our Return Policy. Approved returns credit 1 lead to your balance. No cash refunds are issued.
10. Audit and complaint cooperation
If we receive a consumer complaint, regulator inquiry, or carrier escalation relating to Leads delivered to you, or if we reasonably suspect a breach of this Agreement, you agree to cooperate in good faith with our investigation, including providing information about your contact practices and compliance procedures reasonably related to the matter. We may review your use of the Service for compliance with this Agreement.
11. Suspension
We may suspend delivery or your account, with notice where practical, if we suspect a breach of this Agreement (including reselling Lead data or compliance violations), payment failure, fraud, or behavior that creates legal risk for us or consumers. Suspension for our own operational reasons will be lifted when operationally possible.
12. Indemnification
You will defend and indemnify us against claims, damages, liabilities, fines, and reasonable costs (including attorneys' fees) arising from (a) your contact with Leads, (b) your violation of applicable law, including telemarketing and consumer-protection laws, or (c) your breach of this Agreement.
13. Term and termination
This Agreement applies while you have an account with us. You may stop buying at any time; there are no contracts or cancellation fees. We may terminate this Agreement if you breach it, including by reselling Lead data or violating compliance responsibilities. On termination for breach, unused lead balances expire. On termination for your convenience or ours without cause, you may request a pro-rata credit for undelivered leads.
14. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to this Agreement is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, or for regulatory fines or penalties arising from your contacting of Leads.
15. Booked appointments
- Calendar accuracy. You must keep your booking calendar accurate and keep unavailable times blocked; an appointment booked into an open slot on your calendar is a valid appointment. You must attend on time and follow the no-show steps in the Return Policy. Do not contact the buyer to cancel or move an appointment before it happens; ask us to reschedule.
- No guarantees. We do not guarantee that a buyer will attend, be interested, qualify, or buy, nor any number of appointments in any period. Delivery pace depends on your calendar availability, caps, and buyer volume. Onboarding takes about 7 days after your calendar setup is complete; timing is an estimate.
- Setup fee. A one-time $500 setup fee is charged with your first appointment purchase and covers calendar setup and onboarding. It is non-refundable once onboarding starts, and is waived for purchases made on or before November 14, 2026.
- Prepaid; chargebacks. Appointment purchases are prepaid and non-refundable except as appointment credits under the Return Policy; credits have no cash value. Before any chargeback, contact us and allow us to resolve the request; an unwarranted chargeback is a breach of this Agreement, and we may suspend the account and recover the disputed amount and fees.
- Compliance. Your compliance duties in Section 4 (TCPA, TSR, DNC, quiet hours, call-recording consent) apply to every appointment call and any follow-up.
- No-show decisions. Our records (booking, confirmation, reminder and call logs) are used to decide no-show reports.
