These Terms of Service ("Terms") are a contract between you and Redeye Leads ("Redeye Leads", "we", "us", "our"). They govern your access to and use of the Redeye Leads website, dashboard, and lead-delivery services (collectively, the "Service"). By creating an account, purchasing leads, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Buyer Agreement. If you do not agree, do not use the Service.

1. Acceptance of these Terms

By creating an account, buying lead credits, or using the Service in any way, you accept these Terms and agree to be bound by them. You also agree to the Privacy Policy, which describes how we handle information, and the Buyer Agreement, which governs the license to and your use of lead data. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" in these Terms refers to both you and that company.

2. Eligibility

The Service is offered only to businesses. You may use the Service only if:

you are at least 18 years old and legally able to form a binding contract;
you are purchasing leads for a legitimate business purpose, such as operating a sales floor or similar outbound sales organization; and
you are not barred from using the Service under applicable law or sanctions.

We may require verification of your business information before activating delivery or fulfilling orders. We may refuse or close accounts that do not meet these eligibility requirements.

3. Accounts and security

You must provide accurate, current, and complete information when creating an account and keep it up to date. You are responsible for all activity that occurs under your account and for keeping your password and account credentials secure. Notify us promptly at ed@redeyeleads.com if you suspect unauthorized use of your account. We may suspend accounts pending investigation of suspected compromise, fraud, or abuse. You may not share account credentials among multiple simultaneous users of a single login in a way that circumvents reasonable access controls; contact us if you need additional seats.

4. Description of the Service

Redeye Leads sells exclusive, pre-qualified consumer leads to sales floors on a pay-per-lead basis. Each lead is a consumer who opted in through our own funnels and passed a soft credit check with a 670+ score. Leads are delivered in real time by email, in your dashboard, and optionally to your CRM webhook. You control your daily and weekly volume caps and your delivery hours, days, and time zone. Lead data is licensed, not sold; the scope of your license is set out in the Buyer Agreement.

We also sell booked appointments: calls our appointment team schedules between credit-checked buyers and your closers on the calendar you provide, sold as prepaid appointment credits. The current price is $300 per appointment, purchased in packs; see the Buyer Agreement and Return Policy for appointment terms, including no-show credits.

5. Pricing and payment

Leads are sold as prepaid lead credits, purchased in packs. The current price is $200 per lead and the minimum order is 25 leads. There are no contracts, no monthly fees, and no setup fees.

Card payments are processed by our third-party payment processor, Stripe. We store only references to your Stripe customer and payment method plus your payment history; we do not store full card numbers.

If you enable auto top-up, you authorize us to charge your saved card through Stripe for the pack size you selected whenever your lead balance falls below your chosen threshold, until you disable auto top-up or your saved card expires or is declined. You may disable auto top-up or change your settings at any time in your dashboard. Declined charges may pause delivery.

Prices may change; changes will not affect credits already purchased. You are responsible for any taxes applicable to your purchases except taxes on our income.

6. Returns

Invalid leads may be returned within 72 hours of delivery under our Return Policy, which is incorporated into these Terms. Approved returns are credited as additional leads in your balance; no cash refunds are issued. Except for credits issued under the Return Policy or as otherwise required by applicable law, all purchases of lead credits are final and non-refundable, including any unused balance remaining if you stop using the Service.

7. Acceptable use

You may not use the Service to:

send spam or unwanted communications, harass or threaten consumers, or make deceptive statements;
violate any applicable law, rule, or regulation;
resell, share, publish, broker, or redistribute lead data, in whole or in part;
reverse engineer, scrape, or interfere with the Service or its infrastructure;
circumvent volume caps, delivery settings, or other Service controls; or
assist any third party in doing any of the above.

8. Your compliance responsibility

When you contact leads, you are solely responsible for compliance with all laws that apply to you, including telemarketing and consumer-protection laws. The Buyer Agreement describes these responsibilities in more detail, including obligations relating to the Telephone Consumer Protection Act, the Telemarketing Sales Rule, state telemarketing laws, and Do Not Call requirements. We make no representation or warranty that any contact you make with a lead complies with applicable law.

9. Intellectual property

The Service, including its website, dashboard, software, design, logos, and content, is owned by Redeye Leads and its licensors and is protected by intellectual property laws. Except for the limited license to use lead data granted in the Buyer Agreement, these Terms do not grant you any rights in our intellectual property, and you may not use our name, marks, or content without our written permission. Your suggestions or feedback about the Service may be used by us without restriction or compensation.

10. Third-party services

The Service relies on third-party services, such as payment processing (Stripe), email delivery, hosting, and CRM webhook integrations you configure. We are not responsible for the availability, accuracy, or acts of third-party services, and your use of them is subject to their terms. If a CRM integration you configure malfunctions or drops deliveries, you remain responsible for monitoring your dashboard and return window.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not guarantee that a lead will answer, be interested, qualify for your offer, or result in a sale, and we do not guarantee any particular close rate, revenue, or other outcome from contacting leads. Our obligation is to deliver the lead data described in the Terms and the Buyer Agreement. We disclaim any warranty that the Service will be uninterrupted or error-free.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you arising out of or relating to the Service or these Terms is limited to the amount you paid us in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, even if we have been advised of the possibility of those damages. Some jurisdictions do not allow certain limitations; in that case these limits apply to the fullest extent permitted.

13. Indemnification

You will defend and indemnify us against claims, damages, liabilities, and reasonable costs (including attorneys' fees) arising from: (a) your contact with leads or other use of lead data; (b) your violation of applicable law, including telemarketing and consumer-protection laws; (c) your breach of these Terms or the Buyer Agreement; or (d) your infringement of a third party's rights. We will defend and indemnify you against third-party claims to the extent they arise from our breach of these Terms, subject to the limitation in Section 12.

14. Suspension and termination

You may stop using the Service at any time; there are no contracts or cancellation fees. We may suspend or terminate your account if you breach these Terms or the Buyer Agreement, fail to pay amounts due, or create risk or liability for us or others, with notice where practical. Unused lead balances expire upon termination for breach. Upon termination not due to your breach, you may request delivery of any remaining prepaid lead credits before termination takes effect, to the extent delivery is operationally possible. Sections that by their nature should survive termination (including Sections 6, 9, 11, 12, 13, 15, and 16) survive.

15. Governing law

These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules.

16. Dispute resolution and class action waiver

Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively by binding individual arbitration administered under the Commercial Arbitration Rules of the American Arbitration Association, seated in Cheyenne, Wyoming, rather than in court, except that either party may bring a claim in small-claims court if it qualifies. You waive any right to participate in a class action, collective action, or representative proceeding, and claims may not be consolidated with those of other customers. If the prohibition on class actions is found unenforceable, this entire arbitration provision will be void. The arbitrator may award the same individual remedies a court could. Judgment on the award may be entered in any court of competent jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version, and the posted version governs your use of the Service. Material changes will be communicated by email or in the Service before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. SMS Program Terms

By opting in to text messages from Redeye Leads you agree to these SMS Program Terms.

Program description: we may send text messages related to your account, customer support, service updates, appointment reminders, and promotional messages about our services.
Opt-in methods: you can opt in by checking an unchecked consent box on our web form, submitting a request that includes our SMS disclosure, or texting the advertised keyword to our number.
Consent not a condition of purchase: consenting to receive text messages is not a condition of purchasing any goods or services.
Message frequency: message frequency varies; typically no more than 5 messages per week.
Costs: message and data rates may apply.
Opt out: reply STOP to cancel at any time. After you opt out, we will send one final confirmation message. Reply HELP for help, or email ed@redeyeleads.com.
Carriers: mobile carriers are not liable for delayed or undelivered messages.
Age requirement: you must be 18 or older to participate in the SMS program.
